Exclusion Rules

NO CHILD SHOULD BE EXCLUDED FOR A FIXED PERIOD IF AS A RESULT THEY WOULD HAVE BEEN EXCLUDED FOR MORE THAN 45 DAYS IN THAT SCHOOL YEAR.

ANY EXCLUSION

The Head Teacher must send the parents a letter immediately, giving the length and the reason for the exclusion.

 

IF EXCLUSION FOR MORE THAN ONE DAY

The School must set and mark work for the excluded child.

 

TOTAL DAYS EXCLUDED BETWEEN 5 AND 15 IN A TERM

The Head Teacher must inform the Local Education Authority.

 

The Head Teacher must inform the Governors.

 

The parents have the right to make ‘written representations’ which must be considered by the Governors.

 

 

 

 

 

The Governors must meet if the parents ask for a meeting.

 

The parents have the right to attend the Governors meeting.

 

TOTAL DAYS EXCLUDED OVER 15 IN A TERM

 

 

The Governors must meet between 6 and 15 days following an exclusion of over 15 days in a term.

 

 

 

 

IF AN EXTERNAL EXAM WOULD BE MISSED

 

 

The Governors must meet.

 

 

 

PERMANENT EXCLUSION

 

The School must set and mark work until the fifteenth day.  After that the LEA should provide between 21 and 25 hours a week, depending on the child’s age.  

The LEA has a duty to provide suitable full-time education ‘at school or otherwise’ from the 16th day after a child is permanently excluded from school.

 

Full-time means supervised education equivalent to that provided by mainstream schools.  The number of hours should be:

5-7’s (Key Stage 1) 21 hours

8-11’s (Key Stage 2) 23.5 hours

12-14’s (Key Stage 3/4) 24 hours

15-16’s (Key Stage 4) 25 hours

 

You should write to the Director of Education as soon as you learn your child has been permanently excluded.

 

Tell the Director the date by which the LEA has a duty to provide full-time education for your child

Tell the Director how many hours the LEA should provide for your child due to their age              (see above).

If your child has Special Educational Needs

 

Inform the Director of the provision that will be required in order for the alternative education provision to be suitable.

 

If your child has a Statement of Special Educational Needs

 

Send a copy to the Director with your letter.

 

Ask the Director for details of how the LEA intends to provide the special educational provision which is specified in Part 3 of the Statement.
